4. Shipping and delivery
Delivery times vary between 2 and 5 working days, except in cases of force majeure.
Shipping is free where specified and only in Rome and Florence for devices requiring specific installation, otherwise it costs between €10 and €20.
Any delays cannot be attributed directly to MIA MEDICAL ITALIA, but to the couriers in charge.
5. Exclusion of Liability for Non-Delivery or Withdrawal
MIA MEDICAL ITALY shall not be liable in the event of non-delivery or delay due to:
- Absence of the addressee at the given address, even in the case of delivery agreed with the courier company;
- Incorrect or incomplete address provided by the customer;
- Failure on the part of the customer, at the time of delivery, to indicate “accettazione con riserva”on the receipt or on the courier's PDA in the event of a damaged or suspect parcel.
In such cases, any costs for storage, redelivery or new shipment shall be borne by the customer.

6. Product Damaged on Delivery
The customer is obliged to check the condition of the outer packaging upon delivery. In the presence of visible anomalies (damaged, wet, opened package, etc.), it is mandatory to sign with "ACCEPT WITH RESTRICTION".specifying the reason (e.g. 'damaged packaging').
If the customer accepts delivery without reservation and subsequently reports damage to the device, MIA MEDICAL ITALIA disclaims all liabilitysince the damage cannot be imputed with certainty to the transport.
Any damage not visible at the time of delivery must be reported by email to [email protected] no later than 48 hours after receipt of the product, enclosing photos and a detailed description of the problem.
After that time, no complaints or replacement requests for transport damage can be accepted.
7. Right of withdrawal and returns
Pursuant to Legislative Decree 206/2005 (Consumer Code), the customer has the right to withdraw from the purchase within 14 days from the date of receipt of the product, without giving reasons.
Exceptions to the right of withdrawal:
In accordance with Art. 59 of the Consumer Code, the right of withdrawal does not apply in the case of rental of medical devicesas it is provision of services relating to the supply of goods that are customised or clearly intended for a specific and urgent usefor which the law does not provide a right of withdrawal.
General Conditions for Withdrawal (Purchase of Goods):
- The product must be undamaged, unused and returned in its original packaging.
- Sealed items that have been opened or used (e.g. disposable or skin contact devices) cannot be returned.
- The customer is responsible for the return shipping costs.
Withdrawal procedure (only for non-excluded purchases):
- Send a written communication to:[email protected]indicating the order number and the reason for return.
- After authorisation, you will receive instructions on how to proceed.
- The refund will be made within 14 days of receipt and verification of the returned product.
8. Security deposit for equipment rental
For the rental of medical devices, MIAMEDICAL ITALIA requires a security deposit the amount of which varies depending on the type of equipment rented. The amount of the deposit is communicated upon confirmation of the order.
Deposit Conditions:
- The deposit is mandatory and must be paid before the device is shipped.
- It is fully returned within 4 working days the return of the device, subject to technical verification.
- The technical inspection is carried out by our competent department to ensure that the equipment is intact, functional and complete with all accessories.
In case of damage, tampering, lack of accessories or abnormal wear of the device, MIAMEDICAL ITALIA reserves the right to retain part or the entire amount of the depositby notifying the customer in writing.
9. Legal Guarantees
All products sold are covered by the legal guarantee of conformity provided for in Articles 128-135 of the Consumer Code.
In the event of a defective or non-conforming product, MIA MEDICAL ITALIA undertakes to replace or refund.
10. Limitation of liability
MIA MEDICAL ITALIA shall not be liable for any direct or indirect damage resulting from improper use of the products sold or from causes not directly attributable to the company.
11. Applicable law and jurisdiction
These Conditions are governed by Italian law.
For any dispute the competent court shall be the court of the place of residence or domicile of MIA MEDICAL ITALIA SRL.
